在这次事件中,消费者李女士(化名)于某日入住了一家五星酒店,入住当晚,她在浴室洗澡时,突然听到一声巨响,浴室的玻璃窗瞬间炸裂,李女士被碎片划伤,紧急送往医院治疗,事后,酒店方面表示,此次玻璃炸裂是由于玻璃质量问题所致,并要求李女士赔偿玻璃损坏的费用。

对此,李女士表示不解,认为酒店作为提供住宿服务的场所,应保证消费者的人身和财产安全,玻璃炸裂导致她受伤,酒店理应承担相应责任,酒店方面却坚持要求李女士赔偿,理由是玻璃损坏并非由消费者造成。
从法律角度来看,五星酒店作为公共场所,有义务保障消费者的人身和财产安全,根据《中华人民共和国消费者权益保护法》第十八条规定:“经营者应当保证其提供的商品或者服务符合保障人身、财产安全的要求。”显然,酒店在此次事件中未能履行这一义务。
根据《中华人民共和国侵权责任法》第三十七条规定:“宾馆、商场、银行、车站、娱乐场所等公共场所的管理人或者群众性活动的组织者,未尽到安全保障义务,造成他人损害的,应当承担侵权责任。”酒店在此次事件中存在过错,应承担相应的赔偿责任。
酒店方面却要求消费者赔偿玻璃损坏的费用,这一做法引发了公众的质疑,在法律上,消费者在此次事件中并无过错,不应承担赔偿责任,酒店作为服务提供方,有责任确保设施安全,若因设施故障导致消费者受伤,酒店应承担赔偿责任。

Furthermore, according to Article 37 of the " tort liability law of the People's Republic of China," "The manager of a public place such as a hotel, shopping mall, bank, station, entertainment place, or the organizer of a mass activity, who fails to fulfill the duty of safety guarantee and causes harm to others, shall bear tort liability." Therefore, the hotel in this incident has committed an error and should bear corresponding compensation liability.
However, the hotel insisted on demanding compensation for the damaged glass, which has caused public doubt. Legally, the consumer in this incident had no fault and should not bear the compensation liability. As the service provider, the hotel is responsible for ensuring the safety of facilities. If a facility failure causes injury to consumers, the hotel should bear the compensation liability.
